General Note:
The following General Terms and Conditions for the use of PumpMove apply to consumers with permanent residence in Germany. For better readability, the masculine form is predominantly used in these terms. It includes all genders as well as persons who do not clearly identify with any gender.
1. Introduction
We, PumpMove, aim to help people enhance their physical and mental strength in order to reach their personal best. Our services and offerings provide the foundation to strengthen body and mind. PumpMove stands for effective training methods, high motivation, and a dedicated community that supports each other both online and offline.
With these General Terms and Conditions, we establish the legal framework for the use of PumpMove’s products, services, content, and features. This includes, in particular, digital content not stored on physical media, such as digital training programs. Please read these terms carefully before you start using our services.
2. Scope of Application
2.1. Contracting Parties and Subject Matter
These General Terms and Conditions form the basis of the contract between you and us, PumpMove, Schloßstraße 74, 70176 Stuttgart (hereinafter referred to as “we” or “PumpMove”). The subject of the contract is the paid or free use of the products and services we provide under the name PumpMove via our websites, software applications, mobile apps, or social media.
2.2. Participation Requirements
Use of PumpMove’s services requires a minimum age of 18 years and full legal capacity.
PumpMove is intended exclusively for consumers who use the services for private purposes. Commercial or business use of the services is expressly prohibited.
2.3. Supplementary Terms
PumpMove reserves the right to define additional conditions for certain services. Users will be informed before use.

3. PumpMove Services and Prices
3.1. Scope of Services
The scope of usable PumpMove services depends on whether you use the free basic functions or paid premium features. Access to extended training programs and functions may require payment, either through a subscription or a one-time fee.
Please note that some training programs may require equipment or accessories (e.g., dumbbells, resistance bands). These are not part of PumpMove services and must be purchased separately.
3.2. Prices and Subscriptions
Current information about prices and subscription models can be found on our website www.pumpmove.com. All prices include applicable VAT.

4. Your Health
4.1. Health Requirements
Use of PumpMove services is at your own risk. You should be in good health before starting any of our training programs. If you have pre-existing conditions or health restrictions, please consult a doctor. This applies especially in cases of:

Operations or other health limitations
When following nutrition plans, make sure that suggested foods do not trigger intolerances or allergies. We advise pregnant or breastfeeding women not to use our training programs.
4.2. No Substitute for Medical Advice
The content and services provided by PumpMove do not constitute medical advice and do not replace medical examination or treatment.
4.3. Development of Training and Nutrition Programs
Our methods are based on current scientific findings. However, we cannot guarantee that all content will always reflect the latest research.
5. User Account
5.1. Registration Process
To use PumpMove services, you must register and create a user account. Registration is possible directly via our website www.pumpmove.com or through our mobile apps.
You may not use domain names or web URLs in your username without prior written consent from us. During registration, you will be asked to accept these Terms and Conditions and the applicable Privacy Policy. After completing registration, we will send you an email asking you to verify your account by clicking “Confirm Account.” You will then be redirected to a confirmation page to complete the process.
Alternatively, you can register using your Facebook, Google, or Apple account. Registration is completed once you enter your credentials for the respective account and confirm the login.
6. Conclusion of Contract
6.1. Registration via Website
If you register via our website www.pumpmove.com, the user contract is concluded once the registration process is completed.
6.2. Registration via Mobile Apps
If you register via a mobile app, the contract is concluded according to the terms of the respective app store (e.g., Apple, Google). Generally, the contract is concluded when you click “Install” and enter your password. Please note that a PumpMove user account must still be created.
6.3. Paid Additional Services or Subscriptions
Additional services can be purchased either via one-time payment or as a subscription.
If purchased via our website, the contract is concluded when you click “Buy Now” and successfully enter your payment details.
If purchased via an app, the contract is concluded with the in-app purchase by confirming in the respective app store.
6.4. Correction of Input Errors
On our website, you can cancel the order process at any time and correct errors before entering your payment details. For in-app purchases, billing is handled directly by the app store provider, and corrections are only possible through the respective store.
6.5. Contract Changes
If you change your subscription (e.g., upgrade), your original subscription ends and the new subscription starts immediately. Amounts already paid will be prorated or refunded, depending on the provider (e.g., Apple, Google). After expiration, the new subscription automatically renews until canceled.
7. Term and Scope
7.1. User Contract
The user contract is valid indefinitely. Some PumpMove services require additional paid features, which are subject to separate terms.
7.2. One-Time Additional Services
One-time services are valid for the specified term and end automatically without cancellation.
7.3. Subscriptions
Our subscriptions have different minimum terms and automatically renew until canceled. Renewed subscriptions may be terminated with one month’s notice at the end of the current term.
7.4. Lifetime Access
PumpMove offers lifetime access to certain services for a one-time fee. Lifetime access ends with your lifetime, discontinuation of the services, or closure of PumpMove’s business. Lifetime applies only to services available at the time of purchase and is non-transferable. Refunds are excluded unless legally required.
8. Payment Terms
8.1. Collection of Fees
Fees for one-time services are due upon contract conclusion.
Subscription fees are charged in advance for the applicable term. Renewal fees are charged at the beginning of the next billing cycle.
For free trial periods, billing begins immediately after the trial ends.
8.2. Default
In the event of payment default, we reserve the right to assert further claims.
8.3. Offsetting and Retention Rights
Offsetting is only permitted if your claims are undisputed or legally established. Retention rights may only be asserted if they arise from the same contractual relationship.
9. Payment Methods
If you purchase paid PumpMove services via in-app purchases, billing is handled by the respective app store provider. Please check with that provider which payment methods are available. For purchases via the PumpMove website, accepted payment methods are listed on www.pumpmove.com. PumpMove reserves the right to offer certain payment methods only after a credit check.
If costs arise because a payment is rejected due to reasons attributable to you (e.g., insufficient funds, exceeded credit card limit), we may charge you for these costs at their actual amount.
If a payment method incurs fees (e.g., installment payments), you will be informed during checkout. Such fees are charged directly by the payment provider and must be paid by you. PumpMove does not refund these fees in case of withdrawal.
We reserve the right to exclude certain payment methods for legitimate reasons and offer alternatives.
If your chosen payment method is blocked (e.g., due to theft or security breaches), please notify us or the payment provider immediately.
10. Right of Withdrawal
10.1. Withdrawal Policy
If you conclude a user contract, purchase a one-time service, or subscription with PumpMove, you have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day of contract conclusion. If a subscription can only be used later (e.g., after activation), the withdrawal period begins when you could first activate it.
The right of withdrawal applies only to new contracts, not to automatically renewed subscriptions. For bundled offers (e.g., “equipment + program bundle”), withdrawal can only be exercised for the entire bundle.

Consequences of Withdrawal
If you withdraw from the contract, we will refund all payments received, including delivery costs (if applicable), within 14 days of receiving your withdrawal. Refunds will be made using the same payment method you used, unless otherwise agreed.
Fees charged by your chosen payment provider (e.g., installment fees) will not be refunded.
If you requested that we begin services during the withdrawal period, you must pay us a proportionate amount for services already rendered.
10.2. Expiration of Withdrawal Right
The right of withdrawal expires if:

the service has been fully performed and you consented to the start of performance, or

digital content has been provided and you expressly consented to the withdrawal right expiring upon provision.

11. Special Promotions and Campaigns
PumpMove occasionally offers special promotions, discounts, or referral programs. Users will be informed via newsletter or on the website. These promotions are not a permanent part of PumpMove’s offerings and are usually limited in time.
Separate terms apply to each promotion, which you can view before participating. If a discount is granted, it generally applies only to the minimum contract term. After automatic renewal, the regular price is charged. You will be fully informed before purchase.
12. Warranty
12.1. Statutory Provisions
Claims based on defective services are subject to statutory provisions. Your consumer rights remain unaffected.
12.2. No Guarantee of Success
PumpMove does not guarantee that you will achieve specific fitness goals by using our services. Success depends on individual factors.
We do not guarantee uninterrupted, error-free availability of content. PumpMove reserves the right to adjust, expand, or discontinue services at any time.
13. Liability
13.1. General
All instructions provided by PumpMove must be followed to avoid injury or health risks. Proper use of equipment remains your responsibility.
13.2. Liability for Free Services
For free services, PumpMove is only liable for intent, gross negligence, or absence of guaranteed features. In cases of gross negligence, liability is limited to foreseeable damages. In all other cases, liability is excluded.
13.3. Liability for Paid Services
For paid services, PumpMove is fully liable in cases of intent or gross negligence. In cases of slight negligence, liability is limited to foreseeable damages essential to contract fulfillment.
Liability for injury to life, body, or health remains unaffected.
13.4. Liability of Employees
Where PumpMove’s liability is limited, the same applies to our employees, representatives, and agents.
13.5. Product Liability
Claims under the German Product Liability Act remain unaffected.
14. Rights of Use to PumpMove Content
PumpMove content is protected by copyright or other laws. You are granted a simple, revocable, non-transferable right to use the content exclusively for private, non-commercial purposes.
Reproduction, public distribution, resale, or creation of derivative works is prohibited. Rights of use expire with the end of the contract.
15. Responsibility for User-Generated Content
15.1. User Responsibility
Users are responsible for any content uploaded. PumpMove does not adopt this content and does not systematically review it. Commercial advertising through user accounts is prohibited.
15.2. Legal Compliance
Users must comply with all applicable German laws. Prohibited are content that:

promotes violence, discrimination, or hate,

is pornographic, offensive, or defamatory,

infringes copyrights, trademarks, or other third-party rights.
PumpMove reserves the right to remove such content without prior notice and to suspend or terminate accounts in case of repeated violations.
15.3. Indemnification
If third parties make claims against PumpMove due to user violations, you agree to indemnify PumpMove at your own expense, including reasonable defense costs.
16. Termination of Contract
16.1. User Contract
You may delete your account at any time without reason, thereby terminating the contract. Deletion can be done in account settings. Please note that your content and training data will be deleted. Paid content will no longer be accessible.
If you terminate your account while an active subscription exists, fees already paid will not be refunded.
PumpMove may terminate the contract with two (2) weeks’ notice in text form, but not before the end of the minimum term or renewal period.
16.2. Subscriptions
Subscriptions must be canceled separately. Website subscriptions can be canceled in your profile or by emailing mail@pumpmove.com. App store subscriptions must be canceled directly in the store settings.
For iTunes subscriptions, cancellation must be made at least 24 hours before the renewal date.
PumpMove may also cancel subscriptions with two (2) weeks’ notice at the end of the minimum term or renewal period.
16.3. Termination for Good Cause
Both parties may terminate immediately for good cause. PumpMove may terminate and delete your account if you repeatedly violate these GTCs or default on payments despite reminders.
17. Data Protection
PumpMove processes your personal data in accordance with the Privacy Policy available at www.pumpmove.com/privacy. There, you will also find details about visibility and privacy settings.
17.1. Privacy Settings
In your profile, you can decide who can see your information (e.g., profile, training data, posts). By default, your data is visible to other users to encourage interaction. You can change this anytime to “Private.”
18. Online Dispute Resolution
The EU Commission provides an online dispute resolution platform available at: https://ec.europa.eu/consumers/odr/.
PumpMove does not participate in consumer arbitration procedures and is not obligated to do so. Our email address is listed in the imprint.
19. Changes to the Terms and Conditions
PumpMove reserves the right to amend these terms in the future if legal, technical, or operational reasons require it. Changes take effect no sooner than two (2) weeks after notification via email.
If you do not object and continue to use our services, the new terms are considered accepted. If you object, PumpMove may terminate the contract.
20. Final Provisions
20.1. Applicable Law
German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws of your country of residence within the EU remain unaffected.
20.2. Place of Jurisdiction
If you have no general place of jurisdiction in Germany or the EU, or move abroad after these GTC come into force, the exclusive place of jurisdiction is PumpMove’s registered office.
20.3. Contract Language
The contract language is German.
20.4. Severability Clause
If any provision of these GTC is invalid, the validity of the remaining provisions remains unaffected.
